Continued use of the Application after any such changes constitutes your consent to such changes.
- No Investment Expectation: You acknowledge that your use of the Application and acquisition of GRAPE tokens (“Tokens”) does not constitute an investment. You have not been induced by any promises or representations of potential profits, and you are participating solely for the purpose of obtaining Tokens for gamified experiences.
- Purpose of Token Acquisition: You are acquiring Tokens solely with the intent to engage in and enjoy the gamified features offered by the Application and not for any investment, speculative, or other financial purposes.
- Market Fluctuations: You understand that the value of Tokens may fluctuate in the open market due to trading activities that are entirely beyond the control of the Application.
- No Expectation of Profit: By acquiring Tokens through the Application, you affirm that you have no expectation of appreciation in value, additional earnings, or any form of financial return or remuneration.
- Token Transfer: After acquiring Tokens, you may transfer them to your personal blockchain wallet via the Polygon network (or another), subject to the Application’s transfer instructions and any applicable network fees.
- Gamification Participation: You must participate in at least one gamified event within the Application before transferring any acquired GRAPE Tokens out of the Application.
- Bonification Withdrawals: If you receive any bonuses as a result of participating in a gamified event, you may withdraw these bonuses using the same payment method used to purchase the Tokens. Bonuses will be disbursed in the same currency as the purchase and will not be converted into GRAPE Tokens.
- Withdrawal Limits: Withdrawal limits are applied daily and are subject to dynamic updates within the Application. These limits may vary per user.
- Fraudulent Activity: Any suspicion of fraudulent activity will result in the immediate suspension of your account and may lead to further investigation and potential legal action.
- Legal Compliance: You agree to comply with all applicable laws and regulations in your use of the Application and in your transactions involving the Tokens.
- No Unlawful or Prohibited Use: You warrant that you will not use the Application for any purpose that is unlawful or prohibited by these Terms.
- Indemnification: You agree to indemnify and hold harmless the Company, its affiliates, officers, agents, and employees from any claim or demand made by any third party due to or arising out of your breach of these Terms, or your violation of any law or the rights of a third party.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without giving effect to any principles of conflicts of law.
- Dispute Resolution: Any disputes arising out of or related to these Terms or the use of the Application shall be resolved through binding arbitration in accordance with the rules of an agreed-upon arbitration body.
- Severability: If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
- Entire Agreement: These Terms constitute the entire agreement between you and the Company and govern your use of the Application, superseding any prior agreements between you and the Company.
